本服务条款（“条款”）规范你对 www.peachyassist.com 网站及 Peachy Assist 应用（合称“服务”）的访问和使用，该服务由 Boltzmann Labs, Inc.（“Boltzmann Labs”“我们”）运营。通过创建账户或以其他方式使用本服务，即表示你同意本条款。

1. 账户

你必须年满 16 周岁并有权订立本条款。你有责任对你的账户凭据保密，并对你账户下发生的所有活动负责。如你怀疑存在未经授权的使用，请通过 info@peachyassist.com 通知我们。

2. 可接受的使用

你同意不会：

• 利用本服务违反任何法律或侵犯他人权利。
• 试图访问不属于你的账户或数据。
• 未经我们事先书面许可，探测、扫描或测试本服务的漏洞。
• 利用本服务传播垃圾信息、恶意软件或非法内容。
• 对本服务进行逆向工程、复制或试图提取其源代码。

3. 你的内容

你保留对提交给本服务的任何内容（“你的内容”）的所有权。你授予 Boltzmann Labs 一项全球性、非排他性的许可，仅为向你提供本服务而托管、处理和展示你的内容。我们不主张对你内容的所有权，除非你明确选择加入，否则我们不会用它来为其他客户训练模型。

4. AI 生成的内容

本服务使用第三方大语言模型来生成文本、图像和其他内容。AI 生成的内容可能包含错误。在依据其做出任何决策之前，你有责任对其进行审查，并确保其使用符合适用法律。

5. SMS / mobile messaging terms

By providing your mobile phone number to the Service — on the signup form at peachyassist.com, in a booking flow, in your account settings, or verbally to our voice agent — you consent to receive transactional text messages from Peachy Assist under the following terms:

• Program name: Peachy Assist Notifications.
• What we send: booking confirmations, appointment reminders, one-time passwords (OTP), delivery/order updates, and account notifications. We do NOT send marketing or promotional messages.
• Frequency: varies based on your account activity (typically 1–10 messages per month per active customer).
• Carrier charges: message & data rates may apply. Boltzmann Labs is not responsible for carrier fees.
• Opt out: reply STOP, UNSUBSCRIBE, QUIT, END, or CANCEL to any Peachy Assist message and we will remove your number from all further SMS. Confirmation will be sent.
• Opt back in: reply START to resubscribe.
• Help: reply HELP or INFO for assistance, or email info@peachyassist.com.
• Supported carriers: AT&T, T-Mobile, Verizon, Sprint, and their affiliates. Carriers are not liable for delayed or undelivered messages.

Your mobile phone number and SMS opt-in status are used exclusively to send the transactional messages described above and to comply with U.S. carrier regulations. We do not sell, share, or transfer your mobile number to third parties for their marketing purposes.

6. Fees

付费功能通过 Stripe 预先收费。提供付款信息即表示你授权 Boltzmann Labs 收取相应费用。订阅将自动续订，直至取消为止。你可随时从账户中取消；取消将在当前计费周期结束时生效。除法律另有要求外，我们不对部分周期提供按比例退款。

7. Termination

你可随时删除你的账户。如你违反本条款、继续提供服务会产生法律或安全风险，或法律有此要求，我们可立即暂停或终止对本服务的访问。第 3、4、7、8 和 9 条在终止后继续有效。

8. Disclaimers

本服务按“现状”和“可用状态”提供，不作任何明示或默示的保证，包括适销性、特定用途适用性或不侵权。我们不保证本服务不会中断或无差错。

9. Limitation of liability

在法律允许的最大范围内，对于因你使用本服务而产生或与之相关的任何间接、附带、特殊、后果性或惩罚性损害，或任何利润、收入、数据或使用方面的损失，Boltzmann Labs 及其关联方概不负责。对于因本服务产生或与之相关的任何索赔，我们的累计责任以下列两者中的较高者为限：(a) 你在索赔前 12 个月内向我们支付的费用，及 (b) 一百美元（US$100）。

10. Governing law

本条款受美国佛罗里达州法律管辖，不适用其法律冲突原则。因本条款或本服务产生或与之相关的任何争议，均应仅由位于佛罗里达的州法院或联邦法院专属管辖并解决。

11. Changes

我们可能会不时更新本条款。当我们做出重大变更时，会在变更生效前通过电子邮件或在本服务中以显著通知的方式告知你。变更生效后继续使用本服务，即构成对更新后条款的接受。
