PeachyTerms of Service

In case of any discrepancy between translations, the English version of these Terms prevails.
These Terms of Service ("Terms") govern your access to and use of the website at www.peachyassist.com and the Peachy Assist application (collectively, the "Service") operated by Boltzmann Labs, Inc. ("Boltzmann Labs", "we", "us"). By creating an account or otherwise using the Service, you agree to these Terms.
1. Account
You must be at least 16 years old and have the authority to enter into these Terms. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us at info@peachyassist.com if you suspect unauthorized use.
2. Acceptable use
You agree not to:
- Use the Service to violate any law or the rights of others.
- Attempt to access accounts or data that do not belong to you.
- Probe, scan, or test the vulnerability of the Service without our prior written permission.
- Use the Service to transmit spam, malware, or unlawful content.
- Reverse-engineer, copy, or attempt to extract the source code of the Service.
3. Your content
You retain ownership of any content you submit to the Service ("Your Content"). You grant Boltzmann Labs a worldwide, non-exclusive license to host, process, and display Your Content solely to provide the Service to you. We do not claim ownership of Your Content and we do not use it to train models for other customers unless you explicitly opt in.
4. AI-generated output
The Service uses third-party large language models to generate text, images, and other output. AI output may contain errors. You are responsible for reviewing it before relying on it for any decision, and for ensuring its use complies with applicable laws.
5. Fees
Paid features are billed in advance through Stripe. By providing payment information you authorize Boltzmann Labs to charge the applicable fees. Subscriptions renew automatically until cancelled. You can cancel any time from your account; cancellations take effect at the end of the current billing period. We do not provide pro-rata refunds for partial periods, except where required by law.
6. Termination
You may delete your account at any time. We may suspend or terminate access to the Service immediately if you breach these Terms, if continued service creates a legal or security risk, or if required by law. Sections 3, 4, 7, 8, and 9 survive termination.
7. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
8. Limitation of liability
To the maximum extent permitted by law, Boltzmann Labs and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or use, arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the fees you paid to us in the 12 months preceding the claim and (b) one hundred US dollars (US$100).
9. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Florida.
10. Changes
We may update these Terms from time to time. When we make material changes we will notify you by email or by a prominent notice in the Service before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
